Dhaka, May 16 (Just News): The Supreme Court today refused to accept a prayer seeking a short order in advance on its judgement that upheld bail for Begum Khaleda Zia in Zia Orphanage Trust case.
Khaleda Zia’s lawyer AJ Mohammad Ali prayed for the short order saying that it is need for furnishing bail bond for Khaleda Zia before the lower court.
He said: “The Supreme Court today upheld the High Court bail order for Khaleda Zia in this case. If she cannot get out of jail due to lack of a copy of the Supreme Court order, it will be illegal detention”.
The Supreme Court refused, saying that there is no rule for the Appellate Division to release any short order in advance on its judgement. It said it will release the full judgement soon.
At one stage AJ Mohammad Ali told the court he did not go to the court with group and was alone at the court.
Then Chief Justice Mahmud Hossian said: “We don’t pass any order by considering any group.”
Then Justice Mirza Hussain Haider, another member of the bench, said the observation made by Advocate AJ Mohammad Ali was seriously objectionable. “You have forced us to react.”
AJ Mohammad Ali said, “The court can react, but the court does not allow us (lawyers) to react”. He was insisting the court for releasing a short order.
Then, Justice Hasan Foez Siddique asked AJ Mohammad Ali why he was arguing with the chief justice as the chief justice had already refused to release any short order.
AJ Mohammad Ali said his observation was not right.
Earlier in the morning, the apex court upheld bail for BNP Chairperson Khaleda Zia in Zia Orphanage Trust case, in which she is currently serving a five-year jail term.
However, this will not mean Khaleda Zia will be released from jail because, as her lawyers said, she is being held behind bars in some other cases.
