SC directed a convict husband to acquit of killing wife

The Appellate Division of the Supreme Court (SC) on Wednesday acquitted a convict who was sentenced to death by a lower court of charges for killing his wife in 2007.

The Appellate Division full bench headed by Chief Justice Syed Mahmud Hossain passed the judgment on majority’s decision after holding hearing on a jail petition of Md Abdul Awal Khan virtually.

State appointed counsel Advocate Helal Uddin Molla pleaded for Awal’s innocence before the apex court, while Attorney General AM Amin Uddin and Deputy Attorney General Bishwajit Debnath stood for the state.

According to the prosecution story is in brief that Awal killed his wife Nargis on July 16, 2007, and her father lodged a case in this regard with Kaliganj Police Station in Gazipur.

Police later summoned Awal for quizzing and showed him arrested in the case.

On August 20, 2008, Gazipur District and Sessions Judge Court convicted lone accused Awal in the case and awarded him with death sentence.

The death reference came to the High Court for its approval and the convict too had filed a jail appeal.

After holding hearing on the death reference and jail appeal, the High Court also upheld Awal’s death sentence.

But the convict later filed another plea with the apex court, challenging the High Court judgment and the Appellate Division today came up with its verdict of his acquittal after holding hearing on the petition.
