Supreme Court on Jurain police assault: Punishment according to deed

The punishment for the altercation between police, a lawyer and locals in Dhaka’s Jurain will be dealt out according to the deed, the country’s apex court said on Tuesday.

The punishment will depend on who is guilty and to what to extent, an Appellate Division bench led by Chief Justice Hassan Foyez Siddiqui observed.

“If the police was guilty in the Jurain incident, they will be brought to book, if the lawyer was at fault he will be punished,” the bench said.

The Appellate Division remark comes after hearing a writ petition.

Senior lawyer Joynul Abedin, Advocate Murad Reza, Barrister Ruhul Kuddus Kajal and Barrister Anik R Haque Pramukh stood for the petitoners.

Meanwhile, Attorney General AM Amin Uddin, Additional Attorney Generals Mehedi Hasan Chowdhury and Sheikh Muhammad Morshed represented the state.

The court asked the petitioners to seek bail for the two lawyers currently in jail with a lower court.

“If they do not grant bail, move the High Court. If the High Court does not give bail then come to us,” the bench said.

The court also ordered the state to file a leave to appeal against the High Court by June 19.

On June 7, Dhaka Lawyers Association members Shohabul Islam Roni and his wife Yasin Jahan Nishan got into an argument with a traffic sergeant in from on Jurain police box.

They were later taken into police custody.

On June 8, a Dhaka court placed five people, including two lawyers, on a three-day police remand in a case filed over assaulting three policemen.

Those remanded are advocate Shohag-Ul-Islam Roni, advocate Yasin Arafat Bhuiyan, Md Sharif, Md Nahid, and Md Russel.

The court granted bail to lawyer Yasin Jahan Nishan, Roni’s wife.

On June 7, traffic Sergeant Ali Hossain filed the case naming three people and around 450 unnamed accused with Shyampur police station.

According to the case, Ali Hossain signalled motorcyclist Rony, who was riding on the wrong side of the road, to stop. Rony's wife Nishat was on the motorcycle with him.

When Sergeant Ali Hossain wanted to see the documents of the motorcycle, Rony locked into an altercation with him.

At one stage, Rony was taken to the nearby police box. Later, when the locals came forward, they (Rony and his wife) gave out wrong information.

Enraged, several people in the area attacked police with sharp weapons. Being informed, Yasir Arafat, the brother of Nishat, who have been residing in the area also went to the spot and joined the locals and vandalized the police box. They also attacked on the police in which the three police men received injuries.

Meanwhile, among the injured, SI Utpal Dutta was rushed to Dhaka Medical College Hospital. He was given first aid at Hospital. The other two injured policemen were undergoing treatment at Rajarbagh Central Police Hospital.
