No legal bar for Md Shahabuddin to take oath as president: SC

The Supreme Court chamber judge today upheld a High Court order that rejected a writ petition challenging the legality of the process of electing Md Shahabuddin as president of the country.

Chamber judge of the Appellate Division Justice Jahangir Hossain Selim rejected a writ petition filed by MA Aziz Khan, challenging the HC order.

In the petition, he sought stay on the HC order and on the gazette notification that declared Md Shahabuddin elected as president of the state.

Following the apex court chamber judge's order, there is no legal bar for Md Shahabuddin to take oath as president and discharge other relevant functions, Additional Attorney General SK Md Morshed told reporters at a press briefing in the attorney general's office.

He added that the SC chamber judge rejected the petition of MA Aziz Khan on the ground that there was no breach of law and constitution in electing Md Shahabuddin as president of the Republic as the post of president is not the office of profit in the service.

A number of lawyers including ABM Altaf Hossain appeared for Md Shahabuddin while MA Aziz Khan argued for himself during the hearing.

On March 15, the HC summerly rejected two separate writ petitions that challenges the legality of the process for electing Md Shahabuddin as president of the country.
