The High Court on Thursday asked the Police Bureau of Investigation again to update it about the progress of probe into the killing of Mahmuda Khanam Mitu, wife of sacked assistant superintendent of Chattagrom Metropolitan Police Babul Akhter, on May 6, 2021
The online bench of justice M Enayetur Rahim and justice Md Mostafizur Rahman set the new schedule as Investigation officer Santosh Kumar prayed for more time to complete the investigation.
Deputy attorney general Sarwar Hossain Bappi submitted the report of the investigation officer to the court on Thursday and said, ‘I will assure you that the investigation will be completed within short time.’
The court observed that the investigation should have been completed earlier but the investigators failed to do so.
The court said that an investigation could not be finished by taking order from the court if the investigators didn’t want to do it.
The court only can push for ending the investigation.
The court came up with the observation while hearing bail prayer of Md Motaleb Mia, alias Wasim, who had been detained in jail for four years and seven months as a suspected accused in the case.
The PBI, in its report to the court on Thursday, said that Wasim shot at Mitu following an order from Musa, a source of ASP Babul Akter.
On December 2, 2020, the High Court asked the PBI to submit a report, by January 31, 2021, on the progress of the probe into the killing.
Unidentified assailants shot at Mitu at the Chattogram city’s GEC intersection in the morning on June 5, 2016, while she was going to drop her son Mahir Akhter, 7, for a bus of Chittagong Cantonment Public School and College.
Babul filed a murder case with Panchlaish police station against three unidentified men.
Inspector Santosh Kumar, earlier on December 2, 2020, told the High Court that the Mitu murder case investigation was at final stage.
He said that three investigators were changed before he was given the responsibility of the investigation.
